General Terms and Conditions of Sale

Article 1: These general terms and conditions apply to the sale of products and services made on the website www.phenixairsoft.com and the Phenix Airsoft store located at 215 Avenue de Coulin, 13420 Gemenos, owned by the company SAS AS IMPORT, 215 Avenue de Coulin – 13420 Gémenos, registered with the MARSEILLE RCS B508 595 691. Therefore, placing an order on the Phenix Airsoft website or making a purchase in-store constitutes acceptance of these general terms and conditions of sale.

Article 1.1: Phenix Airsoft reserves the right to modify or change the products or services presented in the catalog without notice.

The choice and purchase of a product or service are solely the responsibility of the customer. Inability to use the purchased product for any reason, including incompatibility with equipment already owned by the customer, cannot result in compensation or cancellation of the purchase from PHENIX AIRSOFT / AS IMPORT.

Article 1.2: Phenix Airsoft is subject to the regulations imposed by Decree No. 99-240 of March 24, 1999, which prohibits the sale of products to minors (-18 years old). Therefore, any order placed on our website www.phenixairsoft.com means that you are an adult, you know the law, and you accept and acknowledge these general terms and conditions of sale. We cannot be held responsible if you do not comply with this decree or the legislation governing airsoft.

Article 2: To place your order, we provide the following means:

  • Online via our website: www.phenixairsoft.com 24/7

  • Directly at the store: Monday to Friday from 2 PM to 5 PM.

  • By email via the contact form in the "Contact Us" menu.

Placing an Order, Prices, and Payment Methods

Article 2.1: The price of products and services is displayed with all taxes included (TTC), excluding shipping fees, which will be added at the end of the order when the customer selects the preferred shipping method.

Article 2.2: For DOM and TOM, we no longer sell to the overseas territories.

Article 2.3: The payment for the order can be made via different payment methods:

  • Bank Transfer

  • Credit Card

  • PayPal

  • Alma

Article 2.4: Orders validated by payment via bank transfer do not reserve the items in the order until the payment is received and validated. If one or more products are no longer available at the time of payment receipt, a credit equal to the amount of the missing product will be credited to the account of the customer who placed the order.

Shipping, Delivery, and Returns

Article 3: Our team strives to hand over orders to carriers within 24 to 48 business hours following the order, excluding weekends. We prepare orders from Monday to Friday, and hand over orders to carriers from Monday to Friday.

Article 3.1: Delivery times range from 24 hours to 7 days, depending on availability, and are provided for informational purposes only. In case of any delays in shipping due to the carrier, we cannot be held responsible. We indicate an estimated delivery time for each carrier in business days for delivery within mainland France, but this may vary depending on the delivery location. Phenix Airsoft provides one carrier option in addition to allowing you to pick up your order directly from the store:

  • Colissimo at home, in a post office, or in a retailer's relay point.

We are relieved from our delivery obligation in the event of a strike by the carrier, popular movements, force majeure events, or acts of war.

Article 3.2: Shipping fees are calculated by weight starting from the first kilogram. They may vary depending on the delivery country. Phenix Airsoft only delivers within mainland France and EU member countries.

Article 3.3: In the case of a return shipment by the carrier due to an issue on the buyer's part, such as an incomplete or incorrect address, failure to collect the package, etc., the cost of reshipping the order will be at the buyer's expense.

Article 3.4: When preparing orders, if one of the products is temporarily out of stock, we reserve the right to split the order into several shipments, with any additional shipping costs being covered by us. If the replenishment period is too long, the product will be refunded via the payment method used for the order.

Article 3.5: Products comprising the order are shipped at the buyer's risk. Shipping, transportation, and handover to carriers are done by Phenix Airsoft on behalf of the buyer. Therefore, it is the buyer’s responsibility to check the condition of the items upon receipt and note any defects on the delivery note. However, please notify us upon receipt of the goods. We will not accept any complaints related to transport if no reservation has been noted on the delivery note. The mention "subject to unboxing" will not be accepted; any issue related to the carrier using this mention and brought to our attention within 24 hours of delivery will not be accepted.

Article 3.6: Any order is placed in full knowledge of the airsoft rules and legislation of the buyer's country or region. In the case of customs hold, duties, or return to sender, we cannot be held responsible. For any return request, shipping fees will be at the buyer's expense unless an exceptional situation is recognized by our customer service.

Article 3.7: Any return must have been accepted and validated by our services and must follow the return procedure indicated in the response to your request submitted via our contact form, available in the "Contact Us" menu. In the case of withdrawal, please refer to the article below; for warranty claims, refer to article 3-8.

Article 3.8: Return shipping fees for incompatibility with your own equipment, size, color, or model errors remain the buyer's responsibility, as well as for exchange returns. In the event that return shipping fees are waived, this remains a goodwill gesture and cannot be considered a routine practice.

Warranty

Article 4: Phenix Airsoft guarantees its products against hidden defects, in accordance with the Civil Code and articles 1641. This warranty is exclusive of other guarantees, particularly regarding the satisfaction of the buyer’s specific needs.

Article 4.1: Phenix Airsoft includes a 12-month warranty on mechanical components for any electric, gas-powered (including CO2), or manually recharged airsoft replica sold on its website or in-store, for reasonable use without aesthetic or mechanical modifications and by following the manufacturer's technical instructions and usage guidelines.

Article 4.2: The commercial warranty covers random mechanical failures and incidents. It excludes maintenance operations, adjustments, electrical wiring modifications, tuning, and failures caused by normal wear, external causes, or improper use, including for gas-powered replicas, the use of unsuitable gas or improper weather conditions.

The warranty does not cover failures resulting from:

  • Handling accidents, theft, fire, freezing, or immersion

  • Excess, lack, or insufficient lubrication, or other maintenance issues

  • Any internal or external modifications

  • Normal wear of parts

  • Negligence by the user during the warranty period and misuse

Any sign of disassembly (screws, rivets, serial number, labels, pins, etc.) may result in the cancellation of the warranty.

Article 4.3: Magazines for replicas are covered by a 30-day warranty from the receipt or in-store purchase date, in case of manufacturing defects recognized by the technician. Any warranty claim after this period will be considered a goodwill gesture.

Article 4.4: Batteries are covered by a 14-day warranty in case of manufacturing defects recognized by the technician. Any warranty claim after this period will be considered a goodwill gesture.

Any malfunction or damage resulting from improper use is excluded from the warranty.

The following malfunctions are not covered:

  • Excessive discharge of Li-Po and Li-Fe batteries beyond the minimum operational threshold.

  • Failures caused by short circuits due to battery modifications, immersion, or contact with conductive liquids.

  • Improper charging methods or settings for the battery (charging a Li-Po or Li-Fe battery as NiMh, polarity reversal, excessive current or voltage, etc.) or using an incompatible charger.

  • Incidents caused by external sources (polarity reversal, short circuits in the replica, defective chargers, etc.)

  • Using a battery in equipment that requires more electrical power than the battery can provide.

Article 4.5: All warranties are non-transferable and are only valid for the original purchaser.

Article 4.6: Any unreported and unapproved modification by the technician may lead to a charge for the repair needed to restore the equipment's functionality, or complete cancellation of the warranty.

Article 4.7: Any warranty claim must follow these steps:

  • First, contact our customer service through the contact form in the "Contact Us" menu on our website to organize the return and check whether the defective equipment will be accepted before shipping.

  • Products must be returned in their original packaging with all accessories (batteries, covers, chargers, manuals, etc.).

  • Returned equipment must be protected from external elements and shocks during transport; otherwise, we may refuse the package upon receipt. If return shipping fees were covered by Phenix Airsoft and the package is refused due to non-compliance with the return policy, you will be responsible for the cost of reshipping.

  • A copy of the purchase invoice and warranty claim approval must be included; otherwise, the return will be placed on hold pending additional information from you, and we cannot be held responsible for any delay in processing.

Article 4.8: Under the legal warranty of conformity, the customer:

  • Benefits from a two-year period from the delivery of the goods to take action.

  • Can choose between repair or replacement, subject to the cost conditions provided by article L.211-9 of the Consumer Code.

  • Is not required to provide proof of the defect within six months following delivery. This period is extended to twenty-four months starting March 18, 2016, except for second-hand goods.


Right of Withdrawal

Article 5: In accordance with applicable laws, the customer has a period of 14 calendar days to exercise the right of withdrawal. This period starts from the day the order is received, with the carrier's date stamp serving as proof. To exercise this right, the customer must contact customer service to inform them of their desire to withdraw from all or part of their order. After the 14-day period, the customer loses the right of withdrawal.

Article 5.1: The customer must return the product(s) at their expense, complete, in their original packaging, and undamaged. All accessories (packaging, manuals, stickers, etc.) must be present and in new condition. Otherwise, the right of withdrawal cannot be exercised. The purchase invoice and the duly completed withdrawal form must be included in the package. This form can be downloaded here.

Article 5.1-1: The right of withdrawal cannot be exercised in the following cases:

  • Products sold by the meter (camouflage netting, rope, etc.)

  • Products sold in sealed packaging where unsealing renders the product no longer new.

  • Services or products that involve intervention on mechanical parts.

  • Products modified at the customer's request.

Article 5.2: If the buyer wishes to exercise their right of withdrawal, they can request a refund or store credit for the affected product(s). Phenix Airsoft commits to processing the refund or store credit within 14 days following receipt and inspection of the returned items.

This charter describes how AS IMPORT, located at 215 Avenue de Coulin 13420 Gemenos, France, handles personal data collected from its customers on the www.phenixairsoft.com website for distance sales.

Collected Data:
In connection with the online sale of airsoft equipment, AS IMPORT collects personal information during registration and order validation, including:

  • Name and surname

  • Postal address

  • Email

  • Date of birth

  • Phone number

Optional personal data, such as preferences regarding product models, energy types used by replicas, or color, may also be collected. Any data provided is collected exclusively for processing orders, technical improvements, and promotions directly from AS IMPORT. AS IMPORT undertakes to never sell or share customers' data with third parties.

Jurisdiction Attribution

Article 8: These general terms and conditions of sale are governed by French law, both for their interpretation and execution. In case of a dispute, the customer should first contact PHENIX AIRSOFT / AS IMPORT to seek an amicable solution. If no solution can be found between the two parties, the customer may turn to a mediator:

Any disputes related to the formation, execution, or cessation of contractual obligations between the parties, which cannot be resolved amicably, will be subject to either one of the territorially competent jurisdictions under the Code of Civil Procedure or the jurisdiction of the place where the customer resided at the time of the conclusion of the contract or the occurrence of the dispute.
