Decree No. 99-240 of 24 March 1999 concerning the requirements for marketing certain objects having the appearance of a firearm

The Prime Minister,

On the report of the Minister of Justice, Minister of Justice, Minister of the Interior, the Minister of Defence and Minister of the Economy, Finance and Industry,

Having regard to Directive 98/34 / EC of the European Parliament and of the Council of 22 June 1998 laying down standards and technical regulations and the letter received May 28, 1997 to the European Commission by which the French Government seized the IRP;

Given the Penal Code, in particular Articles 121-2, 131-41 and R. 610-1;

Given the Consumer Code, and in particular Article L. 221-3;

Considering the opinion of the Committee on Consumer Safety dated 2 July 1997;

Article 1:The offer, Offering for sale, sale, free distribution or making available for consideration or for new or used objects having the appearance of a firearm intended to launch rigid projectiles, when they develop mouth an energy greater than 0.08 joule and up to 2 joules are regulated under the conditions defined by this decree.

 

Article 2:The sale, free distribution to minors or making available for consideration or of the products referred to in Article 1 of this Order are prohibited.

 

Article 3:The indication of the energy expressed in joules developed by the products listed in Article 1 of this Order shall be listed both on the product, its packaging and the obligatory enclosed operating instructions.

 

Article 4:The packaging and the instructions for use of the products referred to in Article 1 of this Decree shall disclose, in legible, visible and indelible, the two statements: Distribution prohibited to minors and Caution: Never direct the fire towards no one.

Article 5:Is punishable by a fine for 5th class offenses [* penalties *]

1. The act of selling, distributing free of charge to minors, to make available free of charge or to the products referred to in Article 1 of this Decree;

2. Providing the winde, offer for sale, sell, distribute, free of charge, to make available free of charge or to the products referred to in Article 1 of this Decree by ignoring the provisions of Articles 3 and 4 of this Decree.

In case of repetition, the fine provided for the offense of the 5th class contravention applies.

Legal persons may be held criminally liable, in accordance with Article 121-2 of the Criminal Code offenses defined in this section; they incur the penalty of a fine as provided for in Article 131-41 of the Code.

 

Article 6:The Minister of Justice, Minister of Justice, Minister of the Interior, the Minister of the Economy, Finance and Industry, the Minister of Defense, the Secretary of State for Small and Medium Industries, trade and crafts and Secretary of StateIndustry shall be responsible, each in his own sphere, for the execution of this decree, which will be published in the Official Journal of the French Republic.
